{"id":1514,"date":"2014-04-07T01:41:33","date_gmt":"2014-04-07T01:41:33","guid":{"rendered":"https:\/\/ryecivicleague.org\/?p=1514"},"modified":"2024-06-20T05:25:22","modified_gmt":"2024-06-20T05:25:22","slug":"rcl-notes-march-20-2014-bos-meeting-on-conservation-bond","status":"publish","type":"post","link":"https:\/\/ryecivicleague.org\/?p=1514","title":{"rendered":"RCL Notes March 20, 2014 BOS meeting on Conservation Bond"},"content":{"rendered":"<p><!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\"><br \/>\n<html><body><\/p>\n<p align=\"center\"><strong><span style=\"font-family: Times New Roman; font-size: small;\">NOTES OF MARCH 20, 2014 SPECIAL RYE BOARD OF SELECTMEN MEETING<\/span><\/strong><\/p>\n<p align=\"center\"><span style=\"font-family: Times New Roman; font-size: small;\">Final Revision B &acirc;&euro;&ldquo; Provided by the Rye Civic League<\/span><span style=\"font-family: Times New Roman; font-size: small;\">&Acirc;&nbsp;<\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Present:&Acirc;&nbsp; Selectmen Jenness and Mills.&Acirc;&nbsp; Not present:&Acirc;&nbsp; Selectman Craig Musselman.&Acirc;&nbsp; Also present:&Acirc;&nbsp; Michael Magnant, Sally King, Jaci Grote (the last two, of the Conservation Commission).&Acirc;&nbsp; Present, but not returning after consultation with counsel:&Acirc;&nbsp; Town Moderator Bob Eaton.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Members of the public present: Peter Crawford<\/span><\/span><\/p>\n<p><span style=\"text-decoration: underline;\"><span style=\"font-family: Times New Roman; font-size: small;\">Consultation with counsel (4:00 p.m.)<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; The meeting was originally noticed for 4:00 p.m.&Acirc;&nbsp; At that time, or shortly thereafter, the above-indicated persons had gathered.&Acirc;&nbsp; Much of the time was devoted to small talk, until at approximately 4:13 p.m. Mr. Magnant and two of the Selectmen went upstairs.&Acirc;&nbsp; None of this appears on the video, which begins after the consultation upstairs had ended.&Acirc;&nbsp; <em>See N.H. Rev. Stat. Ann. 91-A:2, I(b) (exempting consultations with legal counsel from being considered public meetings).<\/em><\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; As people were gathered, waiting for the meeting to start, Town Administrator Michael Magnant indicated that he had lined up Town Attorney Donovan so that the legal options could be discussed.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Selectman Mills asked whether Bob and Sally could join that discussion.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Bob Eaton suggested that that could create an issue of attorney client privilege.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; There was small talk, and after a while, Mr. Magnant suggested that they talk with Attorney Donovan first.&Acirc;&nbsp; Mr. Magnant and Selectmen Jenness and Mills then went upstairs.&Acirc;&nbsp; After a few minutes, one of them came down and asked Sally King and Bob Eaton to join them.&Acirc;&nbsp; Jaci Grote remained downstairs.<\/span><\/span><\/p>\n<p><em><span style=\"font-family: Times New Roman; font-size: small;\">The video begins at 5:11:58 p.m.<\/span><\/em><\/p>\n<p><span style=\"text-decoration: underline;\"><span style=\"font-family: Times New Roman; font-size: small;\">Meeting (0:00 elapsed)<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; The meeting was called to order by Selectman Mills and the pledge of allegiance recited.&Acirc;&nbsp; Selectman Mills then asked whether Selectman Jenness had a motion written down.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Selectman Jenness then moved that a Special Town Meeting be called for Friday, April 11 at 6:30 p.m. to vote on ratification of the procedurally defective town vote on Article 7.&Acirc;&nbsp; The motion carried unanimously.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Selectman Jenness then moved that the required public hearing be held on April 3 at 6:30 p.m. Mr. Magnant indicated that it needed to be seven days in advance of the Town Meeting.&Acirc;&nbsp; The motion carried unanimously.&Acirc;&nbsp; <\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Selectman Jenness then made a motion to authorize Mike Magnant, Town Administrator, to retain Devine, Millimet &amp; Branch P.A. as bond counsel.&Acirc;&nbsp; The motion carried unanimously.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp; Jaci Grote clarified the times.&Acirc;&nbsp; There was then discussion of whether there would be a conflict with the Junior High School.&Acirc;&nbsp; Mr. Magnant indicated that it might need to be at the Elementary School.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;&Acirc;&nbsp;
